Brazil’s Regulator Calls for Lifting a Blanket Ban on iGaming Advertising

Brazil’s Secretariat of Prizes and Bets under the Ministry of Finance (SPA-MF) criticised the initiative to ban the promotion of iGaming platforms completely. The regulator believes that such radical measures will not strengthen the market but rather complicate the current situation.

Members of the supervisory body shared opinions on the potential consequences of implementing Bill No. 3563/2024.

If approved, the project will lead to changes in the following fields:

  1. Traditional and digital media marketing. Commercials on radio, television, newspapers, magazines, posters, and websites are banned. Ads on betting apps for mobile phones, tablets, and smart TVs will also be prohibited.
  2. Sports sponsorships. Clubs, federations, and stadiums will no longer be able to display the logos of gaming companies on uniforms or billboards. Financial support of any public or cultural event will also be forbidden.
  3. Partnership with influencers. Online gambling marketing on social media via celebrities' accounts and digital content producers' streams is also part of the proposed restrictions.

The authority’s representatives believe that such prohibitions would deprive licensed operators of the ability to compete with the shadow sector effectively. They emphasise that without legal offers on accessible web and offline resources, players would turn to illicit platforms, unable to distinguish them from certified alternatives.

SPA’s Plans for Market Regulation

Following criticism of government initiatives, the Secretariat proposed shifting the focus from blanket bans to improving control mechanisms and identifying existing violations. The institution’s members believe that blocking sanctioned products should remain a priority. During the 1st year of the gambling business in Brazil being regulated, over 25,000 domains were closed.

At the same time, the authority intends to strengthen monitoring of influencer activity, particularly regarding advertising involving foreigners. Currently, attention is paid to tracking the compliance of bookmakers' services before major sporting events.
