Peru’s Government, led by President Dina Boluarte, has returned for revision a bill that would adjust the application of the gambling Selective Consumption Tax (ISC) for local and foreign brands.
The document, approved by Congress earlier this summer, would also have criminalised falsifying or manipulating sports outcomes. After receiving comments, the draft was sent back to Parliament for possible corrections or approval without changes.
A letter addressed to Congress and signed by Ms Boluarte and Eduardo Arana, the state’s Prime Minister, was pinned. It notes that the current ISC regulation for remote gaming and sports wagering by foreign operators does not contain the legislative loopholes cited by some niche companies.
Additionally, the authorities emphasised that the proposed modifications to the IGV and ISC Law significantly reduce the taxable base.
Key important insights in this matter:
The Government expects Congressmen to revise some provisions of the initiative and either completely accept the comments or submit an updated version of the text with alternative proposals.
The Executive noted that classifying the falsification of event results in the sector as a crime in the criminal law field is incorrect, since these actions fall under the category of cyber violation.
The current regulation version adopted by Congress classifies the manipulation of outcomes aimed at obtaining benefits from bets as computer misdeeds. Nevertheless, the Government believes that such illegal doings should be considered as crimes related to bribery.
